So that button from applesauce arrived in the mail

It was damaged during shipping so it had a big dent in it. I managed to fix most of it though.

Then chloe told me that the landlord called while I was gone today and said that since my sister and I didn't pay our portion of the rent (We thought she payed it in full and that we were just supposed to pay her back but were waiting for our dad to pay us back all the money we've loaned him since we have no money right now) so that means we violated the lease agreement and are now off the lease and even if we manage to pay the rent back we can't get back on it. So our deposit fees were used as the rent money for this month and we now have until the end of this month to move out  bassir;

Oh and my sister was driving in the snow today to get back her deposit fee from her last place, when she slid along the ice and barely tapped the guy in front of her. Neither cars were damaged and both parties agreed to ignore the event when the police came, somehow decided my sister was drunk (she wasn't, she's just weird and is sick right now) so they took her to the police station, took her blood, and towed her car to the other side of town, with her purse and cell phone inside. We'll have some friend take us over there tomorrow to get the car, I hope.

Oh and I was unlocking my bike today to go home from class when the key broke off inside the lock so now it's stuck at school and I had to wait around for like 3 hours today to get a ride home.

Well, I'll probably have to look for a new place now, but I'm going to talk to the landlord tomorrow about it and tell her about the misunderstanding.
I'm being surprisingly calm right now, but this is fucked up. I just have this week of school left and then finals to get through plus somehow getting to class without my bike or anything. I'm pretty much out of food, I have $20 in the bank (just enough to not go under the minimum or whatever bullshit), I need a job, I still need to add 3 more classes to my schedule even though all of them are pretty much filled up now, I need to make sure my grades are good so I don't lose my scholarship,  I need to call the community college I attended over the summer about the financial aid I never received, and I'm cold and tired and hungry.
I hope my dad realizes this is his fault for being a lying piece of shit and asking his own kids for money and not paying back, he's taken a few hundred from my twin sister and he took like $500 from my older sister ON HER BIRTHDAY.
[spoiler]I do feel kind of bad for him since his long-term girlfriend broke up with him recently and he's been out of work and his roommate went brain-dead on thanksgiving when it was just the 2 of them
But he also does nothing but repeat the same things over and over and he does nothing but mope about it and come over to my home in phx and make a drunken ass of himself [/spoiler]

Wow, that's some shit luck. Your landlord does have to evict you with a court decision before you actually have to move out, though, so you might be able stay if you try to talk to them and haven't received a physical notice of eviction yet...

uh yeah except if you get an actual eviction filed you will be fucked so hard. if he wants you out and you know you violated the lease, gtfo or you'll get fucked. that's all there is to it.

I was told there would be some sort of paperwork involved, although I'm not sure. I haven't seen an actual notice yet, but she probably has it ready.

you should call her and ask what you can do to get out without her filing an eviction.

Evictions stay on your 'record' (7 years or something) and basically disqualify you from renting from any halfway legitimate landlord in the future.

I was just saying that he's not legally obligated to do anything until he sees an actual notice.

I'd recommend calling your landlord and explaining the situation, and how you had no intent on slacking on rent payments, and see if you can 'work something out' (like pay landlord for the lost time when he/she didn't have your check, or something) before they actually go to a court to get the eviction processed.

If you get an eviction filed against you you will have a tough time finding another apartment ever.

Legally you knew it, because you signed it.

If you can convince your landlord to let you stay that's one thing, but assuming it's in the lease, she doesn't have to let you stay, and you should do your best to cut a deal with her that will keep her from filing an eviction.

This is pretty weird to evict someone after a single late payment, but if it's in the lease...

It is weird, but it would be in their best interest to let you stay anyway (if you can show you won't do it again and didn't mean to), since they won't have to waste money finding a new tenant... so Plan A definitely call right away and calmly explain your situation and assure them it won't happen again, please can you stay, willing to make amends etc, and Plan B okay fine you will leave immediately on good terms but without a court order. Any reasonable landlord will do this

Yes. At work we pester people about late rent, but don't file evictions until they are about 2 1/2 months behind. Even then, if they pay it, they can just leave. Same goes with evicting anyone for any other reason. No matter what the reason for the eviction the last call is always "you have 24 hours to get your shit out or we're filing papers" rather than "we're filing papers".

Your landlord doesn't want empty apartments. She doesn't want to go to court. She doesn't want to pay legal fees. Do what Dan said, maybe you can stay. At the least you should be able to leave without her filing anything.

I wonder what if she's already filed it though, what then? I'm new to this, so if I am indeed off the lease and have to move out this month does that mean I am being evicted or is the eviction more of a last-resort thing to get out out of the place?

I've already said I am calling the landlord tomorrow to explain the situation. I'm not sure if I can exactly pay extra though, seeing as I actually don't have the money right now or anything. My dad should be paying me back any day now, but who honestly knows. I really shouldn't have loaned him that money.

Explain to me in more detail this whole eviction thing, because I'm not sure if I entirely understand it. I was not told that I was being evicted, but that I was no longer on the lease so I would have to move out by the end of the month. If it means anything, with this lease we're allowed to end the lease and move out at any time we want, so we're not locked into a "living here for a year" or whatever even though it is a 1-year lease.

Well chloe would still be allowed to stay here, but she can't afford this place by herself so  wonder what her plan is...
