I'm putting together a little ditty involving Zechariah Chafee and first amendment theory and everything. Can't really stand the guy and his very black and white views.
But, I'm interested in trying to apply some of his theory to modern free speech examples.
There's the whole concept of "worthwhile" and "worthless" degrees of speech that warrant different levels of protection from the first amendment.
But, what are some examples of "worthless" speech or message? I automatically drift towards the baseless hate speech influences, but even Westboro's demonstrations should be protected under the first amendment, I think.
Can't have the good without the bad.
So, what actually constitutes something that should be "forbidden" or at least less deserving of constitution protection?
I don't think walking around naked is protected speech.
fake "Art" created with the sole intention of selling it to achieve objectively destructive ends, and where it overlaps with propagated verbal messages ex. Nicki Minaj
Fart noises.
Things done to cause panic, like screaming "HE HAS A GUN" in a crowded area.
I'm coming to the realization that perhaps everything should be protected. For the life of me I cannot come up with a fool proof scenario.
Even cursing and nudity seem like legitimate freedoms to argue for.

I also want freedom for the people of Syria. A massacre is underway there.
