Title: So that button from applesauce arrived in the mail

It was damaged during shipping so it had a big dent in it. I managed to fix most of it though.

Then chloe told me that the landlord called while I was gone today and said that since my sister and I didn't pay our portion of the rent (We thought she payed it in full and that we were just supposed to pay her back but were waiting for our dad to pay us back all the money we've loaned him since we have no money right now) so that means we violated the lease agreement and are now off the lease and even if we manage to pay the rent back we can't get back on it. So our deposit fees were used as the rent money for this month and we now have until the end of this month to move out  bassir;

Oh and my sister was driving in the snow today to get back her deposit fee from her last place, when she slid along the ice and barely tapped the guy in front of her. Neither cars were damaged and both parties agreed to ignore the event when the police came, somehow decided my sister was drunk (she wasn't, she's just weird and is sick right now) so they took her to the police station, took her blood, and towed her car to the other side of town, with her purse and cell phone inside. We'll have some friend take us over there tomorrow to get the car, I hope.

Oh and I was unlocking my bike today to go home from class when the key broke off inside the lock so now it's stuck at school and I had to wait around for like 3 hours today to get a ride home.

Well, I'll probably have to look for a new place now, but I'm going to talk to the landlord tomorrow about it and tell her about the misunderstanding.
I'm being surprisingly calm right now, but this is fucked up. I just have this week of school left and then finals to get through plus somehow getting to class without my bike or anything. I'm pretty much out of food, I have $20 in the bank (just enough to not go under the minimum or whatever bullshit), I need a job, I still need to add 3 more classes to my schedule even though all of them are pretty much filled up now, I need to make sure my grades are good so I don't lose my scholarship,  I need to call the community college I attended over the summer about the financial aid I never received, and I'm cold and tired and hungry.
I hope my dad realizes this is his fault for being a lying piece of shit and asking his own kids for money and not paying back, he's taken a few hundred from my twin sister and he took like $500 from my older sister ON HER BIRTHDAY.
[spoiler]I do feel kind of bad for him since his long-term girlfriend broke up with him recently and he's been out of work and his roommate went brain-dead on thanksgiving when it was just the 2 of them
But he also does nothing but repeat the same things over and over and he does nothing but mope about it and come over to my home in phx and make a drunken ass of himself [/spoiler]

Wow, that's some shit luck. Your landlord does have to evict you with a court decision before you actually have to move out, though, so you might be able stay if you try to talk to them and haven't received a physical notice of eviction yet...

uh yeah except if you get an actual eviction filed you will be fucked so hard. if he wants you out and you know you violated the lease, gtfo or you'll get fucked. that's all there is to it.

I was told there would be some sort of paperwork involved, although I'm not sure. I haven't seen an actual notice yet, but she probably has it ready.

you should call her and ask what you can do to get out without her filing an eviction.

Evictions stay on your 'record' (7 years or something) and basically disqualify you from renting from any halfway legitimate landlord in the future.

I was just saying that he's not legally obligated to do anything until he sees an actual notice.

I'd recommend calling your landlord and explaining the situation, and how you had no intent on slacking on rent payments, and see if you can 'work something out' (like pay landlord for the lost time when he/she didn't have your check, or something) before they actually go to a court to get the eviction processed.

If you get an eviction filed against you you will have a tough time finding another apartment ever.

Legally you knew it, because you signed it.

If you can convince your landlord to let you stay that's one thing, but assuming it's in the lease, she doesn't have to let you stay, and you should do your best to cut a deal with her that will keep her from filing an eviction.

This is pretty weird to evict someone after a single late payment, but if it's in the lease...

It is weird, but it would be in their best interest to let you stay anyway (if you can show you won't do it again and didn't mean to), since they won't have to waste money finding a new tenant... so Plan A definitely call right away and calmly explain your situation and assure them it won't happen again, please can you stay, willing to make amends etc, and Plan B okay fine you will leave immediately on good terms but without a court order. Any reasonable landlord will do this

Yes. At work we pester people about late rent, but don't file evictions until they are about 2 1/2 months behind. Even then, if they pay it, they can just leave. Same goes with evicting anyone for any other reason. No matter what the reason for the eviction the last call is always "you have 24 hours to get your shit out or we're filing papers" rather than "we're filing papers".

Your landlord doesn't want empty apartments. She doesn't want to go to court. She doesn't want to pay legal fees. Do what Dan said, maybe you can stay. At the least you should be able to leave without her filing anything.

I wonder what if she's already filed it though, what then? I'm new to this, so if I am indeed off the lease and have to move out this month does that mean I am being evicted or is the eviction more of a last-resort thing to get out out of the place?

I've already said I am calling the landlord tomorrow to explain the situation. I'm not sure if I can exactly pay extra though, seeing as I actually don't have the money right now or anything. My dad should be paying me back any day now, but who honestly knows. I really shouldn't have loaned him that money.

Explain to me in more detail this whole eviction thing, because I'm not sure if I entirely understand it. I was not told that I was being evicted, but that I was no longer on the lease so I would have to move out by the end of the month. If it means anything, with this lease we're allowed to end the lease and move out at any time we want, so we're not locked into a "living here for a year" or whatever even though it is a 1-year lease.

Well chloe would still be allowed to stay here, but she can't afford this place by herself so  wonder what her plan is...

Even though you didn't realize you did anything wrong, you broke the lease agreement, which is all that matters from the landlord's perspective. That's all the evidence a judge needs to approve an eviction.

However, you can't just be told "you're off the lease" and have it count as an eviction -- the landlord has to file for an eviction and have it approved, then deliver the Notice of Eviction to you in person with a date you must vacate the property by. That's the ONLY way you can be forced out of the lease, unless the process is described some other way in the lease itself (check that). Usually that takes at least a couple days, so if this just happened today, you have at least tomorrow to work things out before they file for the eviction.

My deposit fee has been used by the landlady to pay for this month's rent though, so I guess that would mean I legally am allowed to stay without being evicted, but since I am not off the lease this is no longer my house to rent? I'm guessing that's the logic involved here.

So if the landlord hands me a Notice of Eviction in person, that means my background check is fucked?

Okay so I found this paperwork. All it says it something along the lines of "The tenants (me and my sister) mutually agree with the other tenants that we shall remove ourselves from the lease and that the person not leaving understands that they have to pay the rent in full. Chloe's already signed her name in her spaces, and wrote our names into the space for "tenants leaving", so my sister and I just have to sign it to make it official.  I'm wondering if this is a document they use to prevent an eviction, or if it's some sort of voluntary thing for if some people decide to move out... Chloe just told me she only payed her portion of the rent because she can't afford to pay for the whole place in full, so why would she sign that she is going to do just that?

It would have to be explicitly written in the lease, so check it and see where you stand. If there's nothing about this 'off the lease so move out by the end of the month', then you're just being bullied and you have the right to keep paying rent and living there (unless they really are intending to serve you an eviction notice).

Yes, if that happens you'll want to badger them until they agree to drop the court process and let you move out peacefully (without an official eviction). That's what I did. 5thgrade;

I could be wrong, but that sounds like a provision for voluntarily exiting the lease before its term is up. There should be a section that states the exact terms and process for eviction... if you scan the whole thing we can help u

I don't have a scanner, but this is just a simple 1-page piece of paper that says almost exactly what I just said to you, with blanks for the names and a spot for signatures. Nothing about eviction is mentioned, just that rent responsibilities from those leaving are being transferred to those staying. It's really simple, it almost looks like a kindergarten worksheet.

No, your landlord is trying to screw you (not just right now, they always are), you shouldn't trust anything they say. If you don't know the exact wording of the contract, you will have nothing to say to the landlord and will be forced to agree with them. READ IT, WORD BY WORD!

Alright, I just fear that I'll misinterpret/misread a lot of what is says. Still, I'll look I suppose.

Just read the lease and make sure you know what's going on, exactly what they think you did, expect you to do, etc. Explain to them it was an honest mistake that wasn't even made by you, and if the lease doesn't explicitly say that they can evict you for 1 missed payment, tell them so and promise to be on time in the future. It should be fine.

That one-page thing that you're talking about is some voluntary thing. That's good-- it means that hourandlord wants you to leave that way rather than via eviction. wrench;

You should read the lease to check and see if you really did violate the lease agreement. There's a chance that she wants you out even though you didn't violate anything and is trying to trick you into leaving voluntarily. If you did violate it and you can't convince her to let you stay, then you should fill that sheet out.

Update on today:
I managed to get my bike unlocked and took it home thumbup;
My sister thought she was going to have to pay $200 to get her car out of the impound place, but she talked to my uncle
and he figured a way so she got her car out for free + a cab ride thumbup;
Then I asked Chloe if I she had the lease so I could look at it and she said "you got a copy when you moved in" and then closed the door in my face. I definitely was not given a copy when I moved in, and I told her so. She didn't respond. thumbdown;

Well yesterday was the fifth, so does that mean she just filed it as soon as she possibly could?

I'm calling her early tomorrow, because my dad won't have the check for me until tonight or early morning at the latest. I don't want to tell her I can pay her back if I don't have the money to do that with. I have 5 days upon written notice, that which I was not issued. I'll be fine for 1 more day, but I'm definitely calling her tomorrow.
To be honest I'd be okay with moving out if it comes to that because then I could probably find a place closer to school and I wouldn't have to live with her anymore  baddood;

I don't know too much about open jobs right now but I know NAU offers some. I need one, and I'll probably go for one of those.

But yeah, she's been horrible for about 2 months now.

So she had a friend over last night too look at the place, which was way over the line and just shitty of her.
Today I woke up and she had turned the internet off (again) because we hadn't paid her for utilities for this month. So I called my mom and she gave us enough to pay for the internet, and I gave the check to Chloe and she demanded I pay her all of the utilities (included the gas bill SHE racked up) or she would not allow us back onto the network. I told her I have no money right now, to which she said "that's your problem" and demanded the money, and ripped up the check since I told her she can't have that money if it's not going to internet. She also claimed we owed her TWO MONTHS of utilities and/or rent (she wasn't very clear) and said we were taking advantage of her and costing her like $2000, which is a blatant lie.
She then revealed that she actually had paid all of the rent in full, so really we weren't being evicted. Then she called the landlady and told her we hadn't paid the utilities (those being entirely in chloe's name and completely unrelated to the rent) and the landlady was "on her side"  and told chloe that she would reimburse her for our parts of the rent she paid and would use our deposit fees as rent for this month instead. She then also told chloe she would remove us from the lease (I don't think she's legally allowed to do that). I then told Chloe about the written notice required and that most places don't and can't just kick you out for being a few days late on rent, to which she kept insisting you can because it was somehow common sense to her and that's "how things work" for her. She also said we have to be out by the 17th, because that's when her friend is moving in. I insisted that that was definitely not allowed to happen, but she kept obscuring the argument and I just left by then.
Later, she came in and took that "ending lease" paper I mentioned earlier in this thread, without us signing it, and left. My sister was crying because she's moved like 5 times this year. My sister and I then went to the library to use the internet, because I had homework to do. I'm in a class now.
So I've decided that we're just going to move anyways because I can't stand being near this nightmare of a person for another day. Tomorrow's last day of classes, and I want to just go home until Tuesday when I have a final, and I'll stay at a friend's place or something until thursday, when my last final is. We need to figure out where we're keeping our shit for the month, because although we're legally allowed to stay for the rest of the month. But I'll be in Phoenix for my break, until we find a new place for just my sister and I to live in. We're both tired of shitty roommates.
I hope she enjoys having an empty house, since nearly everything outside of her bedroom belongs to us.

Okay so it turns out Chloe was pretty much lying about everything and we have every legal right to stay in the house as long as we keep paying, but we just can't deal with being around her anymore. We talked to the landlady and we was quite nice, we showed her all of our checks etc etc and we told her we'd like to just keep our stuff there until the 17th (at which point we will move things into my step-uncle's church for a few days or something) she told us that she definitely understood and supported our side of the argument, and she prorated our rent for this month, and we actually get $400 of our $900 deposit fees back!
We found a 2-bedroom apartment that will cost about the same as this house (maybe very slightly more on occasion), but since we'll have more money this time (dad will pay me back, I won't be loaning him any money again, move-in charges are being mostly taken care of by my step-dad, etc) so we'll have just enough for 6 months of rent. It's a 12-month lease though, so my sister and I need jobs, obviously.
I am applying for a job at Five Guys tomorrow morning that I'm being told I will almost definitely get, and my sister's "case manager" is going to help her get a job as well! So then tomorrow we're going home for the weekend, coming back for finals, moving our stuff out, and then going back to phx for most of the break.

This should be exciting, if not a bit more costly initially. I was getting tears a little bit because I love my mom so much.

We were, I liked her for a long time. Then her boyfriend started visiting which upset me, and that just made her mad at me. We had some misunderstanding of each other, which ended with her deciding not to be my friend anymore even when we settled out dispute. She's just been getting more and more distant, and more rude, etc. Things were starting to blow over, but then she just got super mad about money.
But yeah, we'll be good on our own. Roommates have been nothing but anguish for hannah her whole college career. You should come visit us!
