Make sure you have your reciept. The thing has to have been bought less than a year ago, which is almost certainly the case, so just calling and proving it with the release date should be good enough for them to allow you to send it back for a new one or a repaired one.
Still, they'll likely send you a new one, which would mean losing all your Wifi data unless you store it on a backup DS. Keep a backup DS handy. china;

Why would I keep a receipt for a year? I have about 20 days left until the year expires, so I guess I have to hurry. Also, I've noticed Wifi data really isn't stored on the system itself. I transferred nothing from my old DS, but have all of my records on my wifi games.

The Games check which DS you use it with, which is odd.
